Terms of Use

1. Acceptance of terms

By creating an account, downloading, or using the Neném Rotina app ("app", "we", "us", "our"), you agree to these Terms of Use and our Privacy Policy. If you don't agree with any part of these terms, you should not use the app.

These terms form a contract between you ("user", "you") and the person/entity responsible for Neném Rotina. The app can be used without creating an account (local mode); even then, using the app means you agree to these terms.

2. Who can use the app

You must have full legal capacity (18 years or older, or be an emancipated minor) to create an account and agree to these terms in your own name. Neném Rotina is intended for adult caregivers (parents, guardians, family members) who log information about a child in their care — the app doesn't collect or process data directly from children, who are not users of the service or account holders.

If you are legally responsible for a child and use the app to log their routine, you confirm that you have the authority to process this data on their behalf under applicable law (including child and adolescent data protection provisions in your jurisdiction).

3. Description of service

Neném Rotina is a child routine tracking app, letting you log feedings, sleep, diaper changes, pumping, solid food introduction, baths, activities, health occurrences, growth measurements, and appointments/vaccines/medications, as well as view history and statistics for these entries.

The app can be used entirely offline, with data stored only on your device, or with cloud sync after creating an account (email/password or Google sign-in). Core features (logging, history, statistics, multiple baby profiles, theme/language/unit customization) are available to all users at no cost.

4. Important notice: the app does not provide medical services

Neném Rotina is a tool for logging and organizing information. It is not a medical device, does not provide diagnoses, and does not replace guidance, monitoring, or consultation with a pediatrician or any healthcare professional. It should not be used as the sole basis for decisions about a child's health.

Charts, percentiles, averages, trends, insights, and any other analytical content shown in the app are generated from the data you enter yourself and are meant only as organizational support — they are not medical advice, have no individual clinical validity, and may not accurately reflect the child's actual health condition (for example, due to typing errors, missed entries, or the inherent limitation of applying a population reference range to an individual case).

In any emergency, concerning symptom, or question about the child's health or development, seek immediate in-person medical care or your local emergency services — never use the app as a substitute.

5. Your account

If you create an account, you're responsible for keeping your password confidential and for all activity that happens on it. Notify us immediately ( suportemhbss@gmail.com) if you suspect unauthorized use of your account.

You're responsible for the accuracy of the data you enter into the app. We're not liable for decisions made based on incorrect, incomplete, or outdated data entered by you or by anyone else with access to your account.

6. Your data and content

The records, information, and content you enter into the app ("your content") belong to you. We don't claim ownership of it. We use and process this content only to operate the service (store, display, sync, generate statistics), as described in the Privacy Policy.

You're responsible for ensuring you have the right to enter any information into the app, including when an entry involves health data for a child in your care.

7. Acceptable use

By using the app, you agree not to:

• Use the app for any unlawful or unauthorized purpose;
• Attempt to gain unauthorized access to other users' accounts, our systems, or the service's infrastructure;
• Reverse-engineer, decompile, or attempt to extract the app's source code, except to the extent expressly permitted by applicable law;
• Interfere with the app's normal operation (e.g., overloading servers, exploiting security vulnerabilities, abusive automated access);
• Reproduce, distribute, or create derivative works from the app, its brand, or its content without prior authorization;
• Enter offensive, unlawful content into the app, or content that violates third-party rights.

We reserve the right to suspend or terminate accounts that violate these terms.

8. Third-party services

The app relies on third-party services to work — Firebase (Google) for authentication, database, and analytics, and Google AdMob for displaying ads. Use of these services is also subject to the respective providers' terms and privacy policies. We're not responsible for the availability, operation, or data practices of these third-party services, except to the extent required by applicable law.

9. Intellectual property

The name "Neném Rotina," its brand, icon, design, source code, and all original app content (except content you enter) are owned by its developers/rights holders and protected by intellectual property law. Nothing in these terms grants you any right to use these properties beyond what's necessary to use the app for its intended purpose.

10. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, or error-free operation.

We don't guarantee the app will always be available, free of bugs, viruses, or other harmful components, or that any defects will be fixed. You use the app at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, Neném Rotina and its developers/rights holders will not be liable for indirect, incidental, special, consequential, or punitive damages, or for data loss, lost profits, or emotional distress, arising from use or inability to use the app — including decisions made based on information logged or displayed by the app.

Nothing in these terms excludes or limits liability that cannot be legally excluded or limited under your jurisdiction (for example, non-waivable rights under applicable consumer protection law).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the app in violation of these terms; (b) infringement of third-party rights by content you entered; or (c) improper use of a child's data without legal authority to do so.

13. Termination

You can stop using the app at any time, and can request deletion of your account as described in How to delete your account. We may suspend or terminate your access to the app, at our discretion, in case of a violation of these terms or as required by law.

14. Changes to these terms

We may update these terms periodically, especially to reflect changes to the app, applicable law, or our practices. The current version will always be available on this page, with the last-updated date shown at the top. Continued use of the app after a change means you accept the new terms.

15. General provisions

If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in full effect. Failure to enforce any provision doesn't waive the right to enforce it later. These terms, together with the Privacy Policy, form the entire agreement between you and Neném Rotina regarding use of the app.
